EU Court of Justice: New directive on tobacco products is valid

The 2014 directive on tobacco products provides for the prohibition of the placing on the market of tobacco products with a characterising flavour and for the standardisation of the labelling and packaging of tobacco products. In addition, it introduces special rules for electronic cigarettes. Poland, supported by Romania, challenged the prohibition of menthol cigarettes. In two other cases the High Court of Justice of England and Wales asked whether a number of provisions of the directive on tobacco products are valid.
The Court has dismissed Poland’s action and confirmed the validity of the provisions of the directive (Press Release Court of Justice of the European Union, 4 May 2016).
