UK: Consultation on review enforcement of copycat packaging

On April 11, the United Kingdom launched a “Call for Evidence” (similar to a public consultation) on a review of the enforcement of the Consumer Protection Act from Unfair Trading Regulations 2008 in respect of copycat packaging. The government has decided to review the case for granting businesses a civil injunctive power in relation to copycat packaging under the CPRs. The call for evidence closes on May 19.
Copycat packaging refers to the practice of designing the packaging of a product to give it the general “look and feel” of a competing well-known brand (typically the market leader). Copycat packaging is distinct from counterfeiting as normally it does not involve copying trademarks.
