Black plastic tray banned?

The black plastic trays used for sliced meat and cheese in The Netherlands may be banned as the Inspectorate for the Environment has issued the opinion that the trays do not comply with the essential requirements. The reason: in practice these trays are not sorted out for material recycling. The essential requirements are part of the European Directive on Packaging and packaging waste and ensure a harmonised European market.
As this issue affects NVC member companies, we have started a study addressing the following questions. Who is affected by this issue? Is actual facilitation of separation for material recycling obligatory for compliance with the essential requirements?
