US: New York City appeals foam ban ruling

Recently the Supreme Court of New York County ruled against a New York City ordinance (Local Law 142) banning EPS products. The plaintiffs argued that there was no proven cost-effective means to recycle the city’ s polystyrene foam was incorrect because Dart Container offered to purchase and recycle the material.
In October 2015, city attorneys filed an appeal (New York County Index No. 100734/15) of the decision. According to the appeal request, “No entity has attempted – let alone proven successful – at recycling dirty consumer foam waste on the scale that would be required for recycling foam products in New York City” (State Recycling Laws Update, 16 November 2015).
